1. Agreement to terms
By creating an account or using Positionly (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
You must be at least 16 years old to use Positionly. By using the Service, you represent that you meet this age requirement.
2. Description of the Service
Positionly is an AI-assisted LinkedIn personal branding platform. The Service includes:
- AI coaching conversations to develop content ideas
- Post drafting, editing, and scheduling
- Carousel/creative generation and PDF export
- Content calendar management
- Publishing to LinkedIn via your connected account
- Brand positioning tools (Narrative Arc, Origin Story)
3. Your account
- You sign in via LinkedIn OAuth. You are responsible for maintaining the security of your LinkedIn account.
- You are responsible for all activity under your Positionly account.
- You must not share your account or let others access it on your behalf without our written consent.
- You must provide accurate information. If any information changes, update it promptly.
4. Content ownership
Your content is yours. You retain full ownership of all posts, carousels, conversations, and other content you create using Positionly.
By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Service. We will never publish your content anywhere without your explicit action.
AI-generated content:Posts and suggestions generated by our AI coach are derived from your input and are owned by you. You are responsible for reviewing all content before publishing to ensure accuracy and compliance with LinkedIn's terms.
5. Acceptable use
You agree not to use Positionly to:
- Generate content that is defamatory, harassing, threatening, or discriminatory
- Impersonate another person or misrepresent your identity or affiliation
- Publish misleading, fraudulent, or deceptive content
- Violate LinkedIn's Terms of Service or Professional Community Policies
- Spam, mass-message, or engage in automated bulk activity on LinkedIn
- Attempt to reverse-engineer, scrape, or extract data from the Service
- Use the Service to build a competing product
- Circumvent usage limits, rate limits, or subscription restrictions
We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.
6. Subscription & billing
- Free tier: Limited features, no payment required.
- Pro tier ($19/month): Billed monthly through Stripe. Your subscription renews automatically each billing cycle.
- Team tier ($59/month): Custom setup, billed monthly through Stripe.
- You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
- We may change pricing with 30 days' notice. Existing subscribers will be notified by email before any price change takes effect.
- All payments are processed by Stripe. We do not store your payment card information.
7. LinkedIn integration
Positionly connects to your LinkedIn account via OAuth to access your profile information and publish posts on your behalf. By connecting your LinkedIn account:
- You authorize us to read your LinkedIn profile data (name, headline, position, etc.)
- You authorize us to publish posts to LinkedIn only when you explicitly click “Publish”
- We will never post to LinkedIn without your direct action — no auto-publishing, no scheduled auto-posts
- You can disconnect your LinkedIn account at any time through your profile settings
Positionly is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation or Microsoft Corporation.
8. AI disclaimer
Our AI coaching feature uses Anthropic's Claude models to generate suggestions, draft posts, and provide strategic advice. You understand and agree that:
- AI-generated content is a starting point, not a final product. You are responsible for reviewing and approving all content before publishing.
- AI suggestions may occasionally be inaccurate, incomplete, or inappropriate. Always verify facts and claims.
- The AI is not a substitute for professional legal, financial, medical, or other expert advice.
- We do not guarantee any specific outcome (follower growth, engagement rates, business results) from using the Service.
9. Intellectual property
The Positionly name, logo, design, and underlying technology are our intellectual property. These Terms do not grant you any right to use our branding or trademarks.
The Service is provided on a subscription basis. You receive a license to use the Service, not ownership of it.
10. Limitation of liability
To the maximum extent permitted by applicable law:
- The Service is provided “as is” without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total liability to you for any claim arising from or related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim.
- We are not responsible for content you publish to LinkedIn or any consequences thereof.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or death/personal injury caused by negligence.
11. Account termination
- You may delete your account at any time. Upon deletion, we will remove your personal data within 30 days, subject to legal retention requirements.
- We may suspend or terminate your account if you violate these Terms, with notice where practicable.
- Upon termination, your right to use the Service ceases immediately. Content you have already published to LinkedIn remains on LinkedIn per their terms.
12. Governing law & disputes
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Positionly is incorporated. For users in the European Economic Area, nothing in these Terms affects your rights under mandatory consumer protection laws.
We will attempt to resolve disputes informally first. If we cannot, disputes shall be resolved through binding arbitration, except where prohibited by applicable law. EU consumers retain the right to bring proceedings in their local courts.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
